Aqua Sri Lanka is operated by Lumenoeva (Pvt) Ltd. The platform helps travellers research Sri Lankan water and ocean experiences, choose suitable coasts and seasons, identify independent providers, and request planning or booking assistance.

2. Acceptance of these terms

By using the website or submitting a request, you agree to these terms and to any additional terms clearly presented for a particular service. If you do not agree, please do not use the relevant service.

3. Enquiries are not bookings

A form submission, email, telephone conversation, proposed itinerary, indicative price or availability check does not create a confirmed booking. A booking exists only when the responsible contracting party issues written confirmation and any required deposit or payment conditions have been satisfied.

4. Independent operators

Watersports centres, instructors, boat operators, wildlife-tour providers, accommodation providers, transport providers and other listed businesses are generally independent third parties. Unless a written booking confirmation expressly identifies Lumenoeva (Pvt) Ltd as the supplier or contracting principal, the contract for the activity is between the traveller and the named operator.

Operators remain responsible for delivering their services, licences, personnel, equipment, safety systems, insurance, permits, cancellations and compliance with applicable law.

5. Selection and verification

We aim to present credible, relevant providers and may request business information, certifications, insurance details, safety procedures or other evidence. A listing, verification label or editorial recommendation is not a guarantee that an operator will remain suitable in every circumstance or that an activity is risk-free. Travellers should review the final operator information and raise any specific safety or accessibility requirements before booking.

6. Traveller information and eligibility

You must provide accurate and complete information relevant to the request, including participant numbers, ages where relevant, experience levels and any material mobility, swimming, medical or safety considerations requested by the operator. You must not participate while impaired or contrary to an operator's reasonable safety instructions.

The operator may refuse or modify participation where conditions, qualifications, health, age, equipment fit or safety considerations make the activity unsuitable.

7. Prices, currencies and availability

Prices displayed on the website are indicative unless expressly stated otherwise. Exchange rates, taxes, park or harbour fees, equipment, transfers, accommodation, private-guide supplements and seasonal surcharges may affect the final price. The written booking confirmation controls if it differs from earlier website information.

8. Payment, cancellation and refunds

Payment schedules, cancellation charges, amendment rules, no-show terms and refund eligibility are governed by the booking confirmation and the terms of the responsible operator or supplier. Aqua Sri Lanka will present those conditions where it is involved in arranging the booking. Bank, card or currency-conversion charges may be non-refundable.

9. Weather, sea conditions and seasonality

Ocean, river and weather conditions can change rapidly. Surf, wind, visibility, currents, water levels, wildlife movements and official restrictions may require a change of location, schedule, route, vessel or activity. Safety decisions made by qualified operators, harbour authorities or relevant officials take priority over the original plan.

10. Wildlife experiences

Wild animals are unpredictable. Sightings, proximity, swimming opportunities and specific species cannot be guaranteed. Travellers and operators must follow applicable permits, distance rules, guide instructions and responsible-wildlife practices. Aqua Sri Lanka may decline to promote an experience that appears inconsistent with animal welfare or safety standards.

11. Inherent activity risks

Surfing, kitesurfing, diving, snorkelling, freediving, rafting, sailing, fishing, kayaking, paddleboarding, motorised watersports and wildlife excursions involve inherent risks, including changing conditions, equipment failure, collision, falls, drowning, decompression illness, marine life and delayed access to medical assistance. Participation is subject to the operator's briefing, waivers, qualifications and risk controls.

12. Travel documents and insurance

Travellers are responsible for passports, visas, entry conditions, licences, vaccinations, medications and any permits applying to their journey. Appropriate travel insurance should cover the chosen activities, medical treatment, evacuation, cancellation and personal possessions. Standard policies may exclude diving, kitesurfing, rafting or other adventure activities unless specifically included.

13. Website information

We take reasonable care when preparing destination, season and operator information, but details can become outdated. Images may be illustrative and conditions vary. Please rely on the latest written confirmation for material booking details.

14. Acceptable use

You must not misuse the website, submit unlawful or misleading material, interfere with security, scrape the platform at scale without permission, impersonate another person, transmit malware, or use contact information for unsolicited marketing.

15. Intellectual property

Unless otherwise stated, the Aqua Sri Lanka name, website design, original text, graphics, database structure and platform materials are owned by or licensed to Lumenoeva (Pvt) Ltd. Operator names, photographs and trademarks remain the property of their respective owners. Personal, non-commercial use of the website is permitted; other reuse requires prior written permission.

16. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, Aqua Sri Lanka is not responsible for an independent operator's acts or omissions, or for losses caused by weather, sea conditions, wildlife, transport disruption, governmental action, traveller error or other circumstances outside our reasonable control.

Where Aqua Sri Lanka is responsible for a loss, liability will be limited to losses that were reasonably foreseeable and directly caused by our breach. We do not exclude liability for fraud, wilful misconduct, or death or personal injury caused by negligence where such exclusion is prohibited.

17. Privacy

Personal information is handled in accordance with our Privacy Policy.

18. Changes and availability of the service

We may update content, features and these terms, or suspend parts of the website for maintenance, security or operational reasons. The version published when you use the service applies unless mandatory law requires otherwise; confirmed bookings remain governed by their written booking terms.

19. Complaints

20. Governing law

These website terms are governed by the laws of Sri Lanka, subject to any mandatory consumer-protection rights that apply in your country of residence. The courts of Sri Lanka will have non-exclusive jurisdiction unless applicable law provides otherwise.
